Default Auto tranny sticking in gear

I have a 2001 Freelander KV6 with auto/tiptronic box and lately find that when cold the gearbox sticks in a gear - usually 4th. If I wait for the car to warm up, and restart the gearbox is fine. As this car does not have a dipstick to check gearbox levels its impossible to know if there is enough fluid in it.
Here's where the fun starts - according to the manual the gearbox takes 4litres of fluid, but according to landrover, it takes 8 litres.
Also Landrover advised me that I need to use their ATF as its different to other ATF's on the market - as far as I can see the only thing different is the price!
Has anyone any advice for me?
