This is probably one of the last places to ask, but I am involved with you guys, and I might as well ask about the following, a true and really aggravating story:
My good friend here at college, lives on campus and was doing alright until now. Two of his other 5 roommates moved out to an apartment chain and that left him and 2 other roommates with him in his dorm. Now the dorm is going to be under renovation by the school, and is forcing all the college tenenants in the apartment to move out to somewhere on campus or off campus, and my friend wants to move off campus with the others left in his dorm, which is the three of them. Now they chose the same set of apartments the others moved to and the three of them payed $100 from the each of them for a security deposit for the 3 bedroom apartment, for a total of a $300 deposit for the apartment. My friend payed, with his mother's money via check, and it of course cleared. My friend was taken ill for the last two weeks, like really bad, even I caught his cold. But then he got better and as he came back to move out with his roommates supposedly, he came back to an empty apartment leaving just his stuff behind. This obviously show that his other 2 roommates moved out without him. He made some calls to the roommates and never got a response. While trying to wave down one of his roommates on campus, that roommate simply ignored him and took off. So later today he came to me, and I am glad he did. I also tried to get ahold of the two and they also ignored me, I have no clue why. Even though my friend put in $100 toward the deposit of this place, he haden't had the time to sign the lease to the apartment. Now he is a little pissed that his other roommates f-ed him over on the move out. And now with finals this week for his class and the urgency to move out of that dorm period, he is at a stand still. Another thing one of the roommates called him back this evening and started messing around with him on the phone by just talking non-understandable language and basically, he was f-ing with my friend. Now then, we couldn't get ahold of the office of these apartments cause of their irregular closing schedule. After driving around the apartments, we saw the roommates' cars parked in front of an apartment, but it is not the one originally thought to be moved into according my friend. I am also helping my friend out by letting him stay with us for a month just so he has some breathing room to get back onto his feet. The thing me and him see is this; the 2 roommates used him and his parents' money towards living in the apartment. Now not only is this wrong it is immorale of them to do such a thing. I dunno, is this also illegal? ![]() We are trying to find anwsers and soon. If anyone has a suggestion on what course of action that must be taken, me and my friend here would greatly appreciate it. ![]() Thanks!

bring them up on tresspassing charges?? Breaking and entering?? ...something to that extent. If its not thier room, they have no right to be there.
Im sure you could get them in pretty deep. Good luck.

Your buddy needs to contact the management of the apartment building that accepted his mother's check. He should camp out on their doorstep if he has to. He then needs to get an explanation why they took his money but didn't give him a chance to sign a lease. You don't say if he took it by in person or mailed it in, but if the apartment manager took a $100 check through the mail and didn't provide your friend with the chance to sign a lease as per a verbal agreement, that would be borderline mail fraud.
If the apartment people took the check in person, I would ask for an explanation as to why they thought your friend was giving them $100 if he wasn't moving in. If they couldn't come up with one, I'd demand the money back and take them to a magistrate court if necessary. If the other two "friends" just completely screwed him over and used his $100 to cover the security deposit but never had any intention of letting him move in, he should throw bricks through their windshields and slit all of their tires. He should also spread vile, horrid rumors about STDs, rectal bleeding and body lice.

realy theres nothing you cant do but f*** with his roommates like find there cars leave notes on them saying stuff like you some girl that wants to date them confuse them. do things like stick a patato in the tail pipe i mean you said you saw there cars so do things that are not ileagle but still anoying. i mean they screwed your friend over so y not get back at them. i mean sure he gor screwed out for some $$$ but thats nothing compaired to the amount of fun you can have messing with some 1. get a bike and pretend you not paying attention and run into them while there walking. or if you realy want to get back at his roommates dump a bottle of oil into there gas tank that will cost them a lot to fix.
i know this probly is no help but to tell you the truth theres nothing you can realy do about this problem. |

Well he handed the check to the management personally. And it has cleared, we will also find out more about this tomorrow. And also is the apartments' responsibilty or is it the roommates' responsibility to present the lease to my friend so that he can sign it?

Also this may sound cheap but we would like something to be done. And $100 is alot of money to us college kids, like towards the payment of a lift or new tires,
. But seriously what happened to my friend is not right at all, and sounds illegal from the apartment's management, and who knows, the roommates as well.

It is the apartment manager's responsibility. Also, why did he give them money without signing the lease? If they wanted to wait to see if the check cleared, I would have told them to fuck off.

Another new development; we tried to call the idiot roommates, this time with my roommate's cell, and see if they picked up. They did, and we started out casual and when we mentioned the $100 that needed to be returned and the irresponsible action of them, they hung up. So we tried again to get their attention to the matter that what they are doing is wrong. We ended up getting their voicemail boxes and leaving some messages about how wrong it was of them to do that to my friend.
But our plan is to go to the management office first thing in the morning and figure out what needs to be done, and if they cannot do anything because of their incompetence, we will either A: Demand $50 from each of the roommates that screwed my friend on the deal OR B: Take the matter to court. It will all depend on who is willing to cooperate.
